Terms of Service

1. Acceptance of Terms

By accessing or using the Servinix platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms.

2. Subscription and Payment

Servinix is offered on a monthly subscription basis. Current pricing:

• AI Service Assistant: $300 per company per month
• GPS Fleet Tracking: $20 per vehicle per month
• Field Service Management: included with any subscription

Subscriptions are billed monthly in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice to existing subscribers.

3. Free Trial

We offer a 14-day free trial for new accounts. No credit card is required during the trial period. At the end of the trial, your account will be downgraded to a limited free tier unless you provide payment information and activate a paid plan. Trial accounts may have usage limits applied.

4. Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date. We do not provide prorated refunds for partial months.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to reverse engineer, decompile, or extract source code from the platform
• Use the AI call handling features in violation of TCPA, CAN-SPAM, or applicable telemarketing laws
• Share your account credentials with users outside your organization
• Use GPS tracking features to track individuals without their knowledge or consent
• Transmit malware, spam, or otherwise disrupt the Service

6. GPS Tracking and Compliance

You are solely responsible for ensuring your use of GPS fleet tracking complies with applicable laws in your jurisdiction, including employee notification requirements. Servinix provides GPS tracking as a tool; compliance with labor laws, privacy regulations, and consent requirements is your responsibility.

7. Data Ownership

You retain ownership of all data you input into the Service, including customer records, work orders, and business data. You grant Servinix a limited license to store and process this data solely to provide the Service. We do not claim ownership of your business data and will return or delete it upon request.

8. Service Availability

We target 99.9% monthly uptime for the core platform. Scheduled maintenance will be communicated 48 hours in advance where possible. Servinix is not liable for losses arising from service interruptions outside our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, Servinix's total liability to you for any claim arising from these terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
